1. Introduction
Welcome to SmallCraftsRoom ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at smallcraftsroom.site (the "Service") operated by SmallCraftsRoom.
By booking a charter or accessing our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.
2. Service Overview
SmallCraftsRoom offers luxury yacht charter services, which include but are not limited to:
- Daily yacht charters
- Sunset cruises
- Business retreats
- Exclusive gatherings
- Prolonged yacht charters
All our services are provided based on availability and favorable weather conditions. Services can be altered or stopped at our discretion at any given time.
3. Booking and Reservations
3.1 Booking Steps
For a charter reservation, customers must:
- Be no younger than 18 years old
- Supply current and full personal details
- Secure the booking with a deposit as outlined in the reservation confirmation
- Consent to these Terms & Conditions
3.2 Confirmation
You will only receive booking confirmation after we have received the necessary payments and have issued a confirmation in writing. At our own discretion, we can deny any individual service.
3.3 Availability
All yacht bookings are contingent on the availability of the vessel and agreeable weather conditions. We will make reasonable endeavors to honor your requested dates and timings.
4. Payment Terms
4.1 Pricing
All prices are expressed in € and are inclusive of any relevant taxes unless stated otherwise. Prices are subject to change without prior notice.
4.2 Payment Schedule
- Initial payment: 50% of the overall cost of the yacht charter due at the time of booking
- Remainder: Due 48 hours ahead of the charter’s commencement
- Other charges (if applicable): Payable at the end of the charter
4.3 Accepted Payment Methods
We accept most major credit cards, direct bank transfers, and certified checks. Our payment systems are secure, utilizing encryption for protection.
5. Cancellation and Refund Policy
5.1 Client Cancellations
- More than 72 hours prior to departure: complete refund minus any transaction charges
- Between 24 to 72 hours before departure: 50% refund
- Less than 24 hours ahead of departure: No reimbursement provided
5.2 Cancellations due to Weather
In cases where the captain determines that weather conditions are unsafe, we offer to:
- Reschedule the charter to a forthcoming available slot with no added cost
- Issue a full refund when rescheduling proves unfeasible
5.3 Mechanical Failures
If your designated vessel experiences mechanical issues, we'll attempt to supply an appropriate alternative. Should no replacement be accessible, a full reimbursement will be issued.
6. Safety and Behavior
6.1 Safety Guidelines
All persons on board should:
- Comply with all instructions provided by the crew
- Make use of any safety gear as needed
- Disclose any health conditions impacting their security
- Stay within designated compartments on the vessel
6.2 Prohibited Items
The following articles are not allowed on the yacht:
- Containers made of glass
- Illicit substances
- Firearms or any form of weaponry
- Pets (excluding cases where prior approval has been obtained)
6.3 Conduct Rules
Passengers are expected to act in a considerate and respectful manner. Should passenger conduct create safety issues or disrupt the enjoyment of others, we retain the authority to end the charter without issuing a refund.
7. Liability and Insurance
7.1 Our Liability Limitations
We limit our accountability to the sum you have paid for the charter. We do not hold responsibility for:
- Injuries to oneself resulting from personal carelessness
- Theft or harm to personal belongings
- Indirect, consequential, or exemplary damages
- Delays brought on by weather conditions or situations outwith our control
7.2 Insurance Coverage
We have sufficient marine insurance for our vessels and operations. Passengers must organise their own insurance to cover travel and personal effects.
7.3 Acknowledging Risk
Engaging in our charter services means accepting that maritime activities possess inherent dangers, for which you are responsible for your personal safety and health.
8. Alterations and Itinerary Adjustments
Due to safety considerations, operational demands, or weather conditions, we hold the right to alter travel plans, routes, or timetables. We will endeavor to arrange an equal alternative experience whenever modifications are necessary.
9. Force Majeure
We bear no responsibility for any modifications, suspensions, or deferments that result from factors outside our control, including but not restricted to:
- Extreme weather states
- Natural calamities
- Governmental directives
- Port suspensions
- Vehicular malfunctions
10. Privacy and Data Protection
We handle your personal data in line with our Privacy Policy. By using our services, you agree to our collection and application of your information as our Privacy Policy outlines.
11. Intellectual Property
Our website's content, such as texts, visuals, trademarks, and imagery, is safeguarded by intellectual property laws. Without our explicit consent, you are not authorized to duplicate, share, or create derivative works.
12. Governing Law
The laws of Monaco govern these Terms, and any disputes will be resolved in the judicial courts of Monte Carlo, Monaco.
13. Changes to Terms
We reserve the prerogative to alter these Terms at any given time. Changes will be shown on our website along with the updated revision date. Continued service use following any modifications indicates acceptance of the new terms.
